Duchess Clothier LLC and its parent, subsidiaries and affiliates, provide their services to you via www.duchessclothier.com, subject to the following conditions. If you visit or shop at www.duchessclothier.com, you accept these conditions. Please read them carefully.
Privacy
Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. Refund Policy
Duchess does not offer refunds or exchanges on any consultation fees, deposits, made-to-order or made-to-measure garments, altered garments, shipping fees, or engraved accessories. When you place your custom order with Duchess, you are agreeing to these terms. Unlike ready-to-wear, custom garments result from a service and are therefore not returnable and not refundable.
Refunds or exchanges for stock items in unused, new condition in original packaging with receipt will be considered within 30 days of purchase date. Any damaged or used goods will not be accepted for refund or exchange. Refunds will be issued according to the original method of payment (i.e., cash, check, or charge). Customer assumes any return shipping fees associated with returns or exchanges.
The Way We Use Information
We use the information you provide about yourself when placing an order only to complete that order. We do not share this information with outside parties except to the extent necessary to complete that order. We save your contact information and body measurements in our database to facilitate easy re-ordering. We do not store your shipping or billing information; you will need to supply this information each time you place an order. We use return e-mail addresses to answer the e-mail we receive. Such addresses are not used for any other purpose and are not shared with outside parties. You can register with our website if you would like to receive our e-mail newsletter as well as updates on our new products and services. Information you submit on our website will not be used for this purpose unless you fill out the Inquiry form indicating so. Finally, we never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

All purchases made at www.duchessclothier.com, are made pursuant to a shipping contract. By purchasing from www.duchessclohier.com, you agree that the title to and risk of loss for such items passes to you upon delivery by Duchess Clothier LLC to the carrier. You also agree to allow Duchess Clothier LLC to choose the transportation mode and transport carrier for the transportation of your purchases and goods or items being sent to you, at the discretion of Duchess Clothier LLC. All losses, partial or otherwise, implied or executed, felt or imagined as incurred due to the use of www.duchessclothier.com or incurred due to a purchase made from www.duchessclothier.com are your sole responsibility. Under no circumstances will Duchess Clothier LLC entertain any claims thus arising. All items purchased from www.duchessclothier.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

While Duchess Clothier LLC and its affiliates do attempt to be accurate in their descriptions, Duchess Clothier LLC does not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free. If a product offered by www.duchessclothier.com itself is not as described or as ordered, your sole remedy is to return it in unused condition for a replacement at no extra charge. Terms and Conditions of Order Placement, Conditions, Refunds and Other Issues
Use of this website implies that all the terms and conditions in regards to orders placed, order placement and other issues concerning orders have been accepted and agreed to.It is understood that an order, once it has been submitted and subsequently processed, cannot be canceled. Should it under some circumstances, be agreed by Duchess Clothier LLC to cancel an order, cancellation charges and fees as there might be, would be deducted from the submitted payment before a refund is issued or a charge back made to the card used for payment submission. All fees, charges and prices are subject to change without prior notice. Should after an order be placed and there be need to make changes to the order, be it changes to colors, fabrics, styles, sizes or any other aspect, Duchess Clothier LLC reserves the right to charge additional fees and incidental charges dependent on the level and depth of such changes as ascertained by Duchess Clothier LLC. It is accepted that all such charges will be duly ascertained by Duchess Clothier LLC and charged as necessary prior to incorporating such changes to the items in the order. We subscribe to the refunds and cancellation policies endorsed by the Association of Sewing and Design Professionals of America. The policy is No Refunds or Returns: There are no refunds or exchanges on custom made garments, fabrics or other materials once they are purchased on your behalf. Once garments leave our facility, all business is completed. Unlike ready-to-wear, custom garments result from a service and are therefore not returnable and not refundable. Refunds and returns on stock items may be considered within 30 days of purchase.
Terms and Conditions of Order Shipments and Dispatch
While Duchess Clothier will try to use its knowledge and experience to decide on the right carrier, Duchess Clothier LLC is held free of liability of any kind should there be a loss of any kind after an order has left Duchess Clothier LLC premises.
Delivery: You may be asked to sign a release upon delivery of the Custom Garment, acknowledging that you have received the Custom Garment. Changes to the Custom Garment after that date are considered alterations and may be charged accordingly depending on the level of required adjustments. Once the Custom Garment leaves our facility, we are not responsible for any further additions, changes, or alterations to the Custom Garment, whether they are made accidentally or intentionally by you or by other parties.
Terms and Conditions of Deadlines and Deliveries
It is understood that turnaround and dispatch of the orders placed at www.duchessclothier.com may vary from time to time depending on current order volumes, work schedules, fabric availability or a particular characteristic of the order placed. Duchess Clothier LLC will try its best to comply with the average turnaround of 12 to 15 weeks from time of order. It is also understood that priority orders will be processed before standard orders. Should in the extremely rare case, there be a delay in the dispatch of a priority order, Duchess Clothier LLC will be held free of all liability. It is understood that www.duchessclothier.com will try to keep as close to the scheduled estimated completion date as possible. However, should it in a rare case, not be possible to do so and should there be a delay in the dispatch of such orders whose estimated dispatch date has passed, Duchess Clothier LLC will be held free of all liability. While, it is understood that it may take 2 to 5 working days for a carrier to deliver an order after it has left the premises of Duchess Clothier LLC, it is also understood that it may take more or less than 2 to 5 working days for actual delivery to take place. Such delays may be due to situations, events, circumstances beyond control such as recipient not being available to accept delivery, delays in transportation, acts of nature, human error, mechanical or technical errors and faults or due customs clearance procedures and/or schedules at the country of delivery. It is therefore and in such cases understood that Duchess Clothier LLC will be held free of all liability.

We reserve the right to make changes to our site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, such condition shall be severable and shall not affect the validity and enforceability of any of the remaining conditions contained herein.
